Welcome to PrimeHire.ai. By accessing and using our website (www.primehire.ai) and its Software application services, you agree to comply with and be bound by the following Terms & Conditions (T&C). These T&C govern your use of our AI-powered recruitment platform and services, including the handling of resumes, contact details, and other personal data. Please read them carefully. If you do not agree with these T&C, please do not use our services.

  1. Definitions
  • "We," "Our," "Us," refer to PrimeHire.ai.
  • "You," "User," refer to any individual or entity accessing or using the website or services.
  • "Services" refer to the AI-powered recruitment solutions offered by PrimeHire.ai, including resume parsing, candidate assessment, and job matching.
  • "Content" refers to any data, text, images, or other material provided or made available by us on the website.
  • "Candidate" refers to any individual whose resume or personal data is processed by PrimeHire.ai.
  • "Client" refers to organizations or entities using PrimeHire.ai services for recruitment purposes.
  1. User Obligations

By using our services, you agree to:

  • Provide accurate and truthful information when creating an account or submitting data.
  • Keep your account information confidential and secure.
  • Use the services in compliance with all applicable laws, both in India and the U.S.
  • Refrain from using the website to engage in any illegal, fraudulent, or harmful activities, including the misuse of candidate data.
  1. Recruitment Process

PrimeHire.ai provides a platform for managing and optimizing the recruitment process through AI-powered tools. Our services include, but are not limited to, the following:

  • Resume Parsing: We extract and structure data from candidate resumes for easy analysis and matching with job descriptions.
  • Candidate Assessment: We use AI to assess candidates' experience, skills and qualifications and fit for specific job roles based on their resumes and other data provided.
  • Job Matching: We match candidates to job opportunities based on their skills, experience, and preferences.
  • Candidate Communication: We facilitate communication between Vendors/ Recruiters and candidates through the platform.
  1. Employee and Employer Data

5.1 Data Collection and Use

  • We collect and process candidate resumes, including contact details such as name, email address, phone number, and other personal data.
  • The data is collected directly from candidates or through job sites, LinkedIn, Vendors, Vendors/ Recruiters, any other sources who can store the resumes and upload them onto the platform.
  • Vendors/ Recruiters can create Job Descriptions showcasing Role & Responsibilities, Hourly Rate, CTC, Work Authorisation, Job location etc based on their resource requirements
  • The data is used solely for recruitment purposes, including matching candidates with job opportunities, assessing their qualifications, and facilitating communication with potential vendors and employers.

5.2 Data Sharing

  • We may share candidate data with our Vendors/ Recruiters who are actively seeking to fill job positions, strictly for the purpose of recruitment.
  • We do not sell or disclose candidate data to third parties for marketing or other purposes not related to recruitment.

5.3 Candidate Rights

  • Candidates or Vendors have the right to delete their personal or Company, JD data from our platform. Requests can be made by contacting us directly.
  • Candidates or Vendors can also request to restrict the processing of their data or object to certain processing activities.
  1. Data Security

We take the security of your data seriously. We implement appropriate technical and organizational measures to protect personal data from unauthorized access, loss, or misuse. These measures include encryption, access controls, and regular security audits.

  1. Data Retention

We retain candidate data for as long as necessary to fulfil the recruitment purposes outlined in these T&C or as required by applicable law. If a Candidate or Vendor requests deletion of their data, we will promptly remove it from our systems, except where retention is required by law.

  1. Subscription plans & payments

The Services are available under subscription plans for various packages on Monthly and Annual basis. Payments for subscription plans can be made via the payment gateway. Your subscription will be automatically renewed at the end of each subscription period unless you downgrade your paid subscription plan or inform us that you do not wish to renew the subscription. If you do not wish to renew the subscription, you must inform us at least seven days prior to the renewal date. If you have not downgrade the subscription and if you have not informed us that you do not wish to renew the subscription, you will be presumed to have authorized Prime Hire to charge the subscription fee.

From time to time, we may change the price of any Service or charge for use of Services that are currently available on primehire.ai. Any increase in charges will not apply until the expiry of your then current billing cycle. In the event any tax such as GST, VAT, sales tax or the like is chargeable by Prime Hire in accordance with any local, state, provincial or foreign laws with respect to your subscription to our Services, Prime Hire will invoice you for such Taxes. You agree to pay Prime Hire such Taxes in addition to the subscription fees. Prime Hire shall provide you with an invoice in the format prescribed by the applicable local, state, provincial or foreign laws to help you avail the applicable input tax credit for the Taxes so paid.

  1. Vendors/ Recruiters Accounts and Administrators

When you sign up for an account for your organization you may specify the administrators, recruiters The administrators will have the right to configure the Services, roles & responsibilities based on your requirements and manage end users in your organization account. If your organization account is created and configured on your behalf by Prime Hire, it is assumed Prime Hire acts as the administrator role for your organization.

You are responsible for (i) ensuring confidentiality of your organization account password, (ii) appointing competent individuals as administrators and recruiters for managing your organization account, and (iii) ensuring that all activities that occur in connection with your organization account comply with this Agreement. You understand that Prime Hire is not responsible for any User, data issues or issues within your internal team.

You are responsible for taking necessary steps for ensuring that your organization does not lose control of the administrator accounts. In such case, you may send an email to support@primehire.ai. In the absence of any specified administrator account recovery process, Prime Hire may provide control of an administrator account, demonstrating authorization to act on behalf of the organization. You agree not to hold Prime Hire liable for the consequences of any action taken by Prime Hire in good faith in this regard.

  1. Intellectual Property

All content on PrimeHire.ai, including text, graphics, logos, and software is the intellectual property of PrimeHire.ai and is protected by Indian, U.S., and international copyright laws. Unauthorized use or duplication of any content is strictly prohibited.

  1. Limitation of Liability

To the maximum extent permitted by law:

  • ai is not liable for any indirect, incidental, or consequential damages arising from your use of our services.
  • Our total liability for any claim arising out of or relating to these T&C or our services shall not exceed the amount you paid, if any, for accessing our services.

  • The services provided by PrimeHire.ai are on an "as-is" basis. We make no warranties, either express or implied, regarding the accuracy, reliability, or suitability of our services for any particular purpose.
  • We do not guarantee uninterrupted access to the website and the application or it is free from viruses or other harmful components.
  • ai is not responsible for how vendors/ Recruiters collect, store, or use data within or outside the platform.
  • ai does not guarantee compliance with data protection laws on behalf of vendors.
  • Any claims, disputes, or liabilities related to vendor-collected data are to be resolved directly between the vendor and the affected parties.
  1. Indemnification

Vendors agree to indemnify, defend, and hold harmless PrimeHire.ai and its affiliates from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the services, violation of these T&C, or infringement of any third-party rights. Vendors agree to indemnify and hold Primehire.ai harmless against any claims, damages, or losses arising from the improper collection, processing, or handling of data by the vendor. This includes, but is not limited to:

  • Breaches of privacy or confidentiality.
  • Unauthorized use or disclosure of data.
  • Regulatory fines or penalties for non-compliance with data protection laws.
  1. Vendor Responsibility and Limitation of Liability

15.1 Vendor’s Sole Responsibility for Collected Data

Primehire.ai provides a platform to facilitate recruitment activities, including resume management, job matching, and interview scheduling. Vendors using the platform are solely responsible for ensuring that all data they collect, upload, and process while using the platform complies with applicable data protection laws and ethical standards.

Specifically:

  • Vendors must ensure that the personal and professional information they collect from candidates, Vendors/ Recruiters, or third parties has been obtained lawfully, with the necessary consent from the data subjects.
  • Vendors are responsible for validating the accuracy, relevance, and legality of the data they upload or process on the platform.
  • Any misuse, unauthorized collection, or sharing of data by the vendor is their sole responsibility.

15.2 Primehire.ai’s Limited Role and Liability

Primehire.ai serves only as a data processor, providing tools and technologies to support vendors in their recruitment and staffing activities. Primehire.ai does not control or have access to the data uploaded by vendors, except for purposes explicitly permitted under the platform’s Terms of Use.

Primehire.ai:

  • Does not vet or verify vendor-collected data for compliance with legal or regulatory requirements.
  • Is not liable for any breaches, inaccuracies, or disputes arising from the data collected or uploaded by vendors.
  • Disclaims responsibility for damages, penalties, or legal actions resulting from improper or unauthorized data collection by vendors.

15.3 Data Ownership and Accountability

All data collected or processed by vendors on the platform remains the property of the vendor or the respective data subject, as applicable. Vendors act as independent data controllers and are solely accountable for:

  • Adhering to relevant privacy and data protection regulations (e.g., GDPR, CCPA, Indian IT Act).
  • Obtaining explicit consent from data subjects for processing and sharing their information.
  • Managing and safeguarding the data they collect, including implementing adequate security measures to prevent unauthorized access or breaches.
  1. Termination

We reserve the right to terminate or suspend your access to our services at any time, without notice, for any reason, including violation of these T&C.

  1. Governing Law
  • Indian Users: These T&C are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India.
  • S. Users: These T&C are governed by and construed in accordance with the laws of the State of [State], United States. Any disputes arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the courts in Dallas, Texas, United States.
  1. Dispute Resolution
  • Indian Users: Any dispute or claim arising out of or relating to these T&C will be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Hyderabad, India in the English language.
  • S. Users: Any dispute or claim arising out of or relating to these T&C will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Dallas,Texas, United States.
  1. Changes to Terms & Conditions

We reserve the right to modify these T&C at any time. Any changes will be posted on this page, and your continued use of the website after such changes have been posted constitutes your agreement to the updated T&C.

PrimeHire.ai ("we," "our," "us") is committed to protecting the privacy of our users ("you," "your"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website (www.primehire.ai), use our Software and services. - Candidates: When you submit your resume or apply for a job through our platform or email or from Vendors or Job sites, we collect personal information such as your name, email address, phone number, home address, educational background, work experience, work authorisation and any other information included in your resume.

- Vendors/ Recruiters: When you register as a client, we collect your name, company name, email address, phone number, and any other relevant business information.

- Payment details: When Client/ Vendor purchase a subscription plan from us, we ask them to provide their Company name, contact information, and Debit/Credit card information or other payment account information. When you submit your card information, we store the name and address of the cardholder, the expiry date and the last four digits of the bank card number. We do not store the actual bank card number. For quick processing of future payments, if you have given us your approval, we may store your bank card information or other payment information in an encrypted format in the secured servers of our Payment gateway service provider.

 2.2 Technical Information

- Log Data: Our servers automatically record information ("log data") created by your use of the services. Log data may include your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device, and application IDs, search terms, and cookie information.

- Cookies: We use cookies to track your activity on our website and store certain information. Cookies are small data files that a website transfers to your device’s hard drive. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.
